Cleaners Battersea Service Terms and Conditions

These Terms and Conditions set out the basis on which Cleaners Battersea provides cleaning services. By booking or using any service offered by Cleaners Battersea, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below.

Client means any individual, company or organisation that requests, books or receives cleaning services from Cleaners Battersea.

Company means Cleaners Battersea, the provider of the cleaning services.

Services means any cleaning or related services supplied by the Company to the Client, including but not limited to domestic cleaning, commercial cleaning, end of tenancy cleaning, one-off deep cleaning, and any additional agreed tasks.

Cleaner means any person engaged by the Company to carry out the Services.

Premises means the property or location where the Services are to be performed.

2. Scope of Services

The Company agrees to provide cleaning Services as described at the time of booking and confirmed in the booking confirmation. The specific tasks, duration and frequency of the Services will be agreed with the Client in advance.

The Client is responsible for providing accurate and complete information about the Premises, including size, condition, access details and any special requirements. The Company reserves the right to adjust the price or time estimate if the information provided is inaccurate or incomplete.

Any additional work not agreed at the time of booking may be carried out at the Company’s discretion and may incur additional charges.

3. Booking Process

Bookings may be made through the Company’s online form or other booking channels specified by the Company from time to time. All bookings are subject to availability and acceptance by the Company.

To make a booking, the Client will be required to provide details such as name, service address, type of Service, date and time requested, and any specific requirements. The Client must ensure that all information provided is accurate.

A booking will be deemed confirmed only when the Company issues a booking confirmation. The Company reserves the right to refuse any booking at its discretion, including where the Premises are not suitable, access is restricted, or the requested tasks fall outside the usual scope of Services.

For regular cleaning Services, an ongoing schedule will be agreed with the Client. Any changes to this schedule, including changes of day or time, are subject to availability and must be agreed with the Company in advance.

4. Client Obligations

The Client must provide safe and reasonable access to the Premises at the agreed time, including any necessary keys, codes or passes. The Client is responsible for ensuring that there is adequate lighting, heating, water and electricity available for the duration of the Service.

The Client must ensure that the Premises are safe and comply with all relevant health and safety regulations. The Client must inform the Company in advance of any hazards, delicate surfaces, fragile items, or areas that require special care.

The Client agrees to store any valuable, fragile or irreplaceable items in a safe place. The Company will not be responsible for items left in unsafe or unstable positions.

If pets are present at the Premises, the Client must ensure that they are safely secured and do not pose a risk to the Cleaner or interfere with the performance of the Services.

5. Payments and Charges

The price for the Services will be confirmed at the time of booking or as otherwise agreed with the Client. All prices are stated in the local currency applicable to the service area and are exclusive of any taxes or charges that may apply, unless stated otherwise.

Payment is due in accordance with the payment terms communicated to the Client at the time of booking. This may include payment in advance, payment on the day of the Service, or invoicing arrangements for commercial Clients. The Company may require a deposit to secure a booking.

The Company reserves the right to adjust its prices from time to time. Any change in price will not affect confirmed bookings unless the scope of work alters or the information provided by the Client was inaccurate.

If the Client fails to make payment in accordance with these Terms and Conditions, the Company may charge interest on any overdue amount and may suspend or cancel further Services until outstanding sums are settled.

Any parking charges, congestion fees or similar costs reasonably incurred by the Company in providing the Services will be payable by the Client and may be added to the invoice.

6. Cancellations, Rescheduling and Access

The Client may cancel or reschedule a booking by giving the Company advance notice within the minimum time specified by the Company for the particular type of Service. Details of any minimum notice period and any applicable fees will be explained at the time of booking.

If the Client cancels or reschedules a booking without giving the required notice, the Company reserves the right to charge a cancellation fee, which may be up to the full price of the scheduled Service.

If the Cleaner attends the Premises at the agreed time and is unable to gain access, or if the Service cannot be performed due to reasons within the Client’s control, the Company may charge the full price of the scheduled Service.

The Company may cancel or reschedule a booking in the event of circumstances beyond its reasonable control, including but not limited to illness, transport disruption, severe weather or other force majeure events. In such cases, the Company will endeavour to provide as much notice as possible and to offer an alternative appointment.

7. Quality of Service and Complaints

The Company aims to provide Services with reasonable skill and care and to a standard consistent with generally accepted industry practices in the cleaning sector.

If the Client is dissatisfied with any aspect of the Service, the Client must notify the Company as soon as reasonably possible, and in any event within a reasonable time after the Service has been completed. The Client should provide details of the issue, including date, time and areas of concern.

Where a complaint is justified, the Company may, at its discretion, offer to re-perform the affected part of the Service or provide an appropriate partial refund or credit. The Company’s liability will be limited as set out in the limitation of liability clause below.

8. Equipment and Cleaning Materials

Unless otherwise agreed, the Company will supply its own cleaning materials and equipment necessary to perform the Services. The Client must ensure that there is access to basic utilities such as water and electricity.

Where the Client requests the use of their own products or equipment, this will be at the Client’s own risk. The Company will not be liable for any damage or unsatisfactory results arising from the use of products or equipment supplied by the Client, including where such products are unsuitable for particular surfaces or materials.

9. Waste Handling and Environmental Regulations

The Company will comply with applicable local waste disposal and environmental regulations relevant to the delivery of the Services in the service area. General household waste and non-hazardous waste generated in the course of the cleaning process will normally be placed in the Client’s designated bins for collection.

The Company does not handle or remove hazardous, clinical, chemical or industrial waste, including but not limited to asbestos, needles, medical waste, solvents, paints, oils or other substances that require specialist disposal. The Client is responsible for arranging proper removal and disposal of such items through authorised channels.

The Client must inform the Company in advance if there are any particular waste management rules or restrictions applying to the Premises, such as specific bin allocation, recycling requirements or building regulations. The Company will make reasonable efforts to follow any such rules when communicated clearly by the Client.

Where the Client requests removal of waste from the Premises beyond the scope of normal household or commercial cleaning, any such removal will be subject to separate agreement and may incur additional charges. The Company reserves the right to refuse removal of any items that it considers unsafe, illegal or unsuitable for transport.

10. Health and Safety

The Company is committed to ensuring the health and safety of its Cleaners, Clients and others who may be affected by its operations. Cleaners are instructed to follow relevant health and safety guidance and to refuse tasks that they reasonably consider unsafe.

The Client must not request or insist on any activity that may be hazardous or fall outside normal cleaning tasks, such as the use of ladders beyond a safe height, moving heavy furniture alone, or handling dangerous substances.

The Client is responsible for immediately informing the Company of any accident, injury or incident occurring during the performance of the Services at the Premises.

11. Liability and Insurance

The Company will exercise reasonable skill and care in providing the Services and will maintain appropriate insurance cover in respect of its legal liabilities arising from the performance of those Services.

The Client must report any alleged damage or loss arising from the Services to the Company as soon as reasonably practicable and provide clear details and supporting information. The Company will investigate and, where appropriate, may submit a claim to its insurers in accordance with policy terms.

The Company’s total liability to the Client in respect of any loss or damage arising out of or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the lesser of the value of the booking during which the incident occurred or the amount actually recoverable under the Company’s relevant insurance policy.

The Company shall not be liable for any indirect, special or consequential loss, loss of profit, loss of business, loss of revenue or loss of opportunity suffered by the Client, whether arising from negligence, breach of contract or otherwise.

The Company shall not be responsible for normal wear and tear, pre-existing damage, defects or deterioration of any item, surface or fixture at the Premises, nor for failure to remove stains or marks that cannot be fully treated with reasonable cleaning methods.

Nothing in these Terms and Conditions shall exclude or limit the Company’s liability for death or personal injury caused by its negligence, or for any other liability that cannot lawfully be excluded or limited.

12. Keys and Security

Where the Client provides keys, fobs, codes or other access devices to the Company, all reasonable steps will be taken to ensure their safe custody. The Client is responsible for ensuring that adequate building and contents insurance is in place.

If a key or access device provided by the Client is lost or damaged by the Company, the Company’s liability will be limited to the cost of a replacement key or device and, if reasonably required, the cost of changing the relevant lock, subject to evidence of cost. The Company will not be responsible for consequential losses arising from any such incident.

13. Conduct of Cleaners

The Company expects all Cleaners to behave in a professional and respectful manner. If the Client has concerns regarding the conduct or performance of any Cleaner, the Client should inform the Company as soon as possible so that appropriate action can be taken.

The Client agrees not to directly employ or engage any Cleaner introduced by the Company for cleaning or related services outside of the Company’s arrangements during the term of service and for a limited period thereafter, unless otherwise agreed with the Company. The Company reserves the right to charge a reasonable introductory or finder’s fee if this restriction is breached.

14. Data Protection and Privacy

The Company will collect and process personal data of Clients for the purposes of managing bookings, providing Services, handling payments and complying with legal obligations. The Company will take reasonable steps to keep such data secure and to use it only for legitimate business purposes.

By making a booking, the Client consents to the Company holding and using their personal data in accordance with applicable data protection laws. The Client may request access to their personal data held by the Company and may ask for corrections where information is inaccurate.

15. Changes to Terms and Conditions

The Company may update or amend these Terms and Conditions from time to time to reflect changes in its operations, services, legal requirements or other relevant factors. Any revised version will take effect when published or from a date specified by the Company.

For ongoing regular Services, the Company will take reasonable steps to notify Clients of any material changes. Continued use of the Services following any change will constitute acceptance of the updated Terms and Conditions.

16. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.

17. General Provisions

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, such provision shall be deemed deleted, but that shall not affect the validity and enforceability of the remaining provisions.

No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy, nor shall it prevent or restrict any further exercise of that or any other right or remedy.

These Terms and Conditions constitute the entire agreement between the Company and the Client in relation to the provision of the Services and supersede any prior understandings, agreements or arrangements, whether written or oral.
